Frequently Asked Questions About Drug Litigation

What is a brand name drug?

A brand name drug is approved by the Food and Drug Administration (FDA), and is supplied by one company (the pharmaceutical manufacturer). The drug is protected by a patent and is marketed under the manufacturer's brand name.

What is a generic drug?

When a drug patent expires other companies may produce a generic version of the brand name drug. A generic medication, also approved by the FDA, is basically a copy of the brand name drug and is marketed under its chemical name.

Are generics as safe as brand name drugs?

Yes. Since generics use the same active ingredients and are shown to work the same way in the body, they have the same risks and benefits as their brand name counterparts.

Does the FDA test drugs?

FDA does not develop, manufacture or test drugs. Drug manufacturers submit full reports of a drug's studies so that the Center can evaluate its data.

Is it legal for me to bring foreign-made medications into the United States?

The United States Federal Food, Drug and Cosmetic Act prohibits the interstate shipment (which includes importation) of unapproved new drugs. Unapproved new drugs are any drugs, including foreign-made versions of U.S. approved drugs that have not received FDA approval.

How many Americans take prescription drugs?

The Department of Health and Human Services (HHS) shows that at least half of all Americans take at least one prescription drug, with one in six taking three or more medications.
